Welcome to JoyFlick (referred to as "the Game", "We", "Us", "Our", or "JoyFlick"). These Terms of Service (the "Terms") form a legally binding agreement between you and JoyFlick regarding your access to and use of the mobile game, related websites, services, and any content or in-app purchases. By downloading, installing, or playing JoyFlick, you agree to be bound by these Terms. If you do not agree, please do not use the Game.
1.1 Eligibility
By using JoyFlick, you confirm that you are at least 13 years old (or the age of digital consent in your country). If you are between 13 and the age of majority, you confirm that your legal guardian has reviewed and agreed to these Terms. We do not knowingly collect personal data from children under 13 without verified parental consent.
1.2 Account Creation
To access features like progress sync, leaderboards, and cloud saves, you may log in via third-party platforms (Game Center, Google Play Games) or play as a guest. You are solely responsible for safeguarding your login credentials. Any activity under your account is your responsibility.
1.3 Account Deletion & Suspension
You may delete your account at any time via in-app settings or by emailing durbrow_dorla@outlook.com. We reserve the right to suspend or permanently ban accounts that violate these Terms, including cheating, abusive language, hacking, or fraudulent payment activities.
2.1 Limited License
JoyFlick grants you a personal, non-exclusive, non-transferable, revocable, limited license to install and play the Game on compatible devices solely for your non-commercial entertainment. All rights not expressly granted are retained by us.
2.2 Updates & Modifications
We may deploy patches, updates, or new versions to improve security, add features, or fix bugs. Some updates may be mandatory to continue using the Game. We are not obligated to support older versions.
The Game may include virtual currency ("Gems", "Coins", "Tickets") and virtual goods (collectively "Virtual Items") that can be earned through gameplay or purchased with real money. Virtual Items have no real-world monetary value and cannot be exchanged for cash, goods, or services outside the Game.
All purchases are final and non-refundable except where required by applicable law (e.g., EU statutory withdrawal rights for unused virtual currency may apply). JoyFlick reserves the right to adjust, modify, or discontinue Virtual Items without liability if necessary for game balance, economy integrity, or legal compliance.
You agree NOT to engage in any of the following prohibited activities:
Violations may result in immediate suspension, forfeiture of Virtual Items, permanent ban, and potential legal action.
All content in JoyFlick – including but not limited to artwork, music, sound effects, character designs, game mechanics, level layouts, logos, and trademarks – is owned by JoyFlick or its licensors. You may not copy, reproduce, distribute, or create derivative works based on the Game without our explicit written permission. Any unauthorized use automatically terminates your license under these Terms.
JoyFlick integrates third-party advertising networks (e.g., AppLovin, Google, Unity Ads) and analytics endpoints (https://hcawf.treafarm.com). These third parties may collect and process data as described in our Privacy Policy. We are not responsible for the content, privacy practices, or terms of any third-party websites or advertisers. Your interactions with them are governed solely by their own policies.
We may terminate or suspend your access immediately, without prior notice, for any material breach of these Terms or for any conduct that harms other users or the integrity of the Game. Upon termination, your right to use the Service ends, and any Virtual Items, progress, or associated data may be permanently lost. You may also terminate this agreement by deleting your account and uninstalling the Game.
THE GAME IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, JOYFLICK DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE GAME WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOU ASSUME FULL RESPONSIBILITY FOR YOUR USE OF THE GAME.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, JOYFLICK AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OR INABILITY TO USE THE GAME, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL CUMULATIVE LIABILITY SHALL NOT EXCEED THE GREATER OF $10 USD OR THE AMOUNT YOU PAID TO US IN THE PAST SIX MONTHS.
You agree to indemnify, defend, and hold harmless JoyFlick, its affiliates, officers, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your violation of these Terms, your misuse of the Game, or your infringement of any third-party rights.
These Terms shall be governed by the laws of the jurisdiction where the Company operates (without regard to conflict-of-law principles). For residents of the European Economic Area, you may benefit from mandatory consumer protections under the laws of your country of residence. Any dispute arising from these Terms shall first be attempted to be resolved through good-faith informal negotiation for 30 days. If unresolved, either party may submit the dispute to binding arbitration or competent courts in accordance with applicable law. Nothing in this section restricts your statutory rights (including GDPR, CCPA, or similar privacy rights).
We reserve the right to revise these Terms at any time. Material changes will be communicated via an in-app notice or email (if you have provided one). Your continued use of JoyFlick after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the new Terms, you must stop playing and delete the Game.
JoyFlick may offer eligible users the ability to redeem certain in-game rewards or request withdrawals (e.g., promotional cash balance) via PayPal. To process a withdrawal, you must provide a valid PayPal email and comply with any verification or minimum threshold requirements. We reserve the right to deny, reverse, or delay any withdrawal if we reasonably suspect abuse, violation of these Terms, technical errors, or fraudulent activity. All approved withdrawals are final and non-reversible.
14.1 Entire Agreement
These Terms, together with our Privacy Policy and any in-game rules, constitute the entire agreement between you and JoyFlick.
14.2 Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
14.3 No Waiver
Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.
